1. Introduction
These Terms & Conditions (“Terms”) govern your access to and use of the Warm Wall Ltd website (the “Website”) and any information, tools, forms or materials made available through it. By using the Website you accept these Terms. If you do not agree, stop using the Website immediately.
2. About us

3. Website purpose and scope
• The Website is provided for marketing, general information and lead generation only. The Website does not itself form any contract for goods or services.
• Website content is for general guidance and explanatory purposes only and does not constitute professional, technical, legal, safety or financial advice. You must not rely on Website content as the basis for any decision affecting property, health, safety or finances without obtaining a formal written quotation and contract from us.
• All Website content and tools are provided “as is”. We make no representations or warranties, express or implied, as to accuracy, completeness, fitness for purpose, merchantability, legality or non‑infringement.
• Any reference to experience (for example “15+ years”) refers to the combined professional experience of our staff and management and not necessarily the age of Warm Wall Ltd as a corporate entity.
• Marketing statements, illustrative claims, pricing examples, savings estimates and references to warranties or guarantees are promotional only. Final terms, availability and any binding warranties are subject to written contract and supplier/manufacturer terms.
4. Interactive tools and calculator
• The Website may include calculators, estimators or other interactive tools (collectively “Tools”). Tools are illustrative, explanatory and marketing‑focused only. Results are estimates based on user inputs, assumptions, modelled calculations and third‑party data and are non‑binding.
• Tool outputs must not be used for final, professional, regulatory or legally binding calculations. A formal on‑site survey, specification and written contract are required before any works are commissioned.
• We may publish a short methodology summary, data sources, model version and last updated date linked from the Tool. We may change assumptions, algorithms or data sources at any time without notice.
• Where a Tool is provided, you may be required to acknowledge a checkbox stating the results are indicative and non‑binding before results are shown. We recommend you save or print any outputs for your records.
• To the fullest extent permitted by law, Warm Wall Ltd excludes all liability arising from or in connection with use of, or reliance on, the Website, calculators, tools or pre‑contract communications. Where liability cannot be excluded by law, our aggregate liability in respect of Website use and pre‑contract communications is capped at £100. Liability for contracted works is governed exclusively by the signed contract.
5. Leads, assessments and quotations
• Any free assessment, indicative estimate or quotation provided via the Website or by email/phone prior to a site survey is indicative only, based solely on the information supplied by the client, and is not a formal offer or binding quotation.
• A full on‑site survey and inspection is required before we prepare formal project documentation, specification or a final binding quotation.
• We may charge for surveys, inspections or specialist reports where specified; charges and payment terms for any paid survey will be made clear in advance.
• We reserve the right, at our sole discretion and without giving reasons, to decline to provide an assessment, quotation, survey or to refuse to enter into a contract with any person or property.
• Clients must provide accurate property information, safe access for inspection and any permissions required for surveys. If access is prevented or information is inaccurate, timescales and prices may change.
6. No online sale; cooling‑off and distance contracts
• The Website is a marketing and enquiry channel only and does not itself create a contract for goods or services. No sale or supply of goods or services is concluded via the Website.
• Any consumer cancellation or cooling‑off rights applicable to bespoke on‑site works will be those expressly set out in the signed contract and applicable law. The Website does not create distance selling obligations by Warm Wall Ltd.
7. Warranties, guarantees and marketing claims
• Any mention of a specific warranty term (for example “10‑year warranty”) on the Website or in marketing materials is illustrative. The existence, scope, duration and conditions of any warranty depend on project specification, materials, installation and supplier/manufacturer terms.
• Final warranty and guarantee terms will be expressly set out in the written contract and project documentation agreed with the client. Manufacturer warranties may require specified maintenance; failure to follow stated maintenance or care requirements may invalidate warranty coverage.
• We reserve the right to withdraw, amend or qualify any warranty or promotional offer at any time prior to contract.
8. Quotes, variations and contract terms
• Website content and indicative quotations do not override or replace the terms of any signed contract. The signed contract and formal specification govern works.
• Quotations may include assumptions and validity periods. If site conditions, access, regulatory requirements or supplier pricing change, quotations may be revised.
• Variations, extras, unforeseen works or remedial items required after inspection will be priced and agreed separately in writing.
9. Payment (where applicable)
• We do not sell goods or services directly via the Website. If we issue an invoice (for example for a paid survey, deposit or other service) the invoice will state the payment due date and accepted payment methods.
• Stage payments, deposits and milestone payments, if applicable, will be set out in the contract. Works may be paused or withheld pending overdue payments.
• We may charge interest on overdue sums and recover reasonable costs of debt recovery in accordance with applicable law.
10. Limitation and exclusion of liability
• To the fullest extent permitted by law, Warm Wall Ltd excludes all liability arising out of or in connection with use of, or inability to use, the Website, Tools and any information on it, including direct, indirect, incidental, consequential, special or punitive losses (including loss of profit, business, revenue, goodwill or data).
• Where liability cannot be lawfully excluded, our aggregate liability in respect of Website use and pre‑contract communications is limited to £1,000 or the available proceeds of our insurer’s policy relating to the claim, whichever is higher. This cap applies to Tool use and pre‑contract communications; liability for contracted works is governed by the signed contract.
• Nothing in these Terms excludes liability for death or personal injury resulting from our negligence, for fraud, or for any other liability which cannot be excluded under applicable law.
11. Force majeure
• We are not liable for failure or delay in performing obligations where such failure or delay is due to causes beyond our reasonable control (including but not limited to extreme weather, strikes, supply chain failures, transport disruption, epidemics, government action or utility outages). We will use reasonable endeavours to notify affected clients and mitigate impact.
12. Health, safety and site conditions
• Clients must ensure safe access to the site and disclose any known hazards, restrictions or relevant site information. We may suspend or refuse works and/or surveys where site conditions present unacceptable health and safety risks. We accept no liability for delays or costs arising from unsafe or inaccessible sites.
13. Materials, substitutions and suppliers
• We will use materials and suppliers of suitable quality. If specified items are unavailable we may propose reasonable equivalent or improved alternatives; substitutions will be agreed in writing. We are not liable where a supplier discontinues an item or changes terms beyond our control.
14. Intellectual property
• All content on the Website including text, images, graphics, logos and layout is owned or licensed by Warm Wall Ltd. No content may be reproduced, distributed, published, adapted or used for commercial purposes without our prior written consent, except for personal non‑commercial use.
15. Third‑party links and disclaimers
• The Website may link to third‑party websites for convenience. We do not control and are not responsible for the content, privacy practices or availability of third‑party sites. Links do not imply endorsement. Use external sites at your own risk.
16. Privacy and cookies
• Our handling of personal data and cookies is set out in our Privacy & Cookies Policy, available from the Website footer. By using the Website you consent to the collection and use of personal data as described in that policy.
17. Complaints and dispute resolution
• If you have a complaint, contact us at info@warmwall.co.uk. We will acknowledge receipt promptly and aim to resolve the matter within 10 working days. Where appropriate we will consider alternative dispute resolution (ADR) procedures. These Terms are governed by the laws of England and Wales and disputes fall within the jurisdiction of the courts of England and Wales subject to any mandatory consumer protections.
18. Changes to these Terms
• We may update these Terms at any time. Updated Terms take effect when posted on the Website with an updated “Last updated” date. Continued use of the Website after changes are posted constitutes acceptance of the revised Terms.
19. Severability, no waiver and entire agreement
• If any provision of these Terms is held to be invalid or unenforceable, that provision will be severed and the remaining provisions will remain in full force. Failure to enforce any provision does not amount to a waiver. These Terms constitute the entire agreement relating to your use of the Website.
